Selling private property in Tennessee involves several best practices to ensure a smooth, legal, and financially sound transaction. Note that real estate laws and practices can evolve, so consulting a local real estate attorney or professional is recommended for the most current and specific advice.
Understand Tennessee Real Estate Laws
No Attorney Requirement: Tennessee does not legally require an attorney for private property sales, but involving one can help ensure compliance with state laws and prevent disputes.
Disclosure Requirements: Tennessee law (T.C.A. § 66-5-201 et seq.) requires sellers to provide a Residential Property Condition Disclosure for most residential properties (1-4 units). You must disclose known material defects, such as structural issues, water damage, or environmental hazards (e.g., lead paint or mold). Exemptions include new construction or transfers like estates or foreclosures.
Transfer Taxes: Tennessee imposes a realty transfer tax of $0.37 per $100 of the property’s sale price or value, typically paid by the seller unless negotiated otherwise.
Title Requirements: A clear title is essential. Conduct a title search to confirm no liens, encumbrances, or ownership disputes exist. Title insurance is common to protect the buyer.
