Annual dues are due within 30 days of statement date. Payments can be mailed or paid at the office.
A member in good standing is current within 30 days. Debt carries with the property. When purchasing a property be certain that dues and taxes are paid!
For 2025: All outstanding past due amounts on September 1, 2025 will generate a 10% interest rate retroactive to February 1, 2025.
For 2026 with new accounting software: All yearly payments are due February 1 of the year. There is a 60 day grace period for 2026 payments due until April 1 of the year. All balances left unpaid ON April 1 generate a 10% interest rate retroactive to the February of each year. A $95.00 past due generates $9.50 monthly.
Delinquency and Lien Policy of December 2025
(Board mandate December 6, 2025)
Policy Statement: The Board of Directors mandates that the organization may initiate a statutory or contractual lien against any member’s property or interest upon the accrual of unpaid assessments, fees, or charges that persist for a period of six (6) months following the original due date.
Procedure:
Notice of Delinquency: Within 30 days of the six-month non-payment threshold, the member will be sent a final written notice via standard mail that details the total outstanding balance and the intent to file a lien if payment is not received within 30 days of the notice date.
Lien Filing: If the outstanding balance is not paid in full by the deadline specified in the final notice, the POA or the organization’s legal counsel is authorized to promptly file the lien. The lien is mailed by Certified Mail – Return Receipt Requested as required by Tennessee law.
Lien Fees: The fee for filing each necessary lien by the POA is $100 per lien, which includes both filing and releasing the lien. If legal counsel is used, then the fee is Attorney Fees plus 20%.
Waiver: The Board retains the exclusive right to waive the filing of a lien on a case-by-case basis under extraordinary circumstances.

LEGAL NOTICE
Members are invoiced each year for what are usually previously known debts that reoccur. Your failure to receive an invoice or losing an invoice does erase your knowledge of the debt or the legal covenant of the debt. This excuse is known as “willful blindness to a known obligation” per the terms of the Warranty Deed for your property.
Therefore, this is your legal notice that dues payments and other repeating debts are due on February 1 of each year. All payments received on April 1 or thereafter will be invoiced late fees of no less than 10% monthly retroactive to February 1 of each year. Old debt adds up fast. For example, with each lot that has dues of $95.00, the late fee is $9.50 monthly, continuously until paid. The POA and its members are not a bank, and if you wish to use your community in this way, you will be automatically invoiced a FINANCE CHARGE. Your involvement in avoiding CHARGES and FEES is key.
A PAYMENT PLAN that you honor with routine payments can be arranged in many cases. A payment plan that is kept by a member keeps a member IN GOOD STANDING. Late payment and non-payment will result in the loss of GOOD STANDING, including any regular communication that you may have set up and access to public facilities/amenities here.
The Cumberland Mountain Retreat is working to improve our community by wisely investing in improvements and better maintenance as possible. You are part of that, including the willingness of volunteer actions on the part of any member.
